Welcome to Peated. These Terms of Service ("Terms") govern your use of the Peated mobile app and related services (together, "Peated"), provided by Glowing Galaxy ("we", "us", or "our"). By creating an account or using Peated, you agree to these Terms. If you do not agree, please do not use Peated.
You must be at least 18 years old to use Peated. Peated is intended for adults interested in whisky, bourbon, and related spirits. You are responsible for complying with all local laws relating to the purchase, possession, and consumption of alcoholic beverages in your jurisdiction. Peated does not sell alcohol or facilitate alcohol purchases.
You may not use Peated if we have previously terminated or banned your account.
You create a Peated account by signing in with Apple or Google. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information (including your display name) and keep your contact details up to date.
Peated lets you record tasting entries, notes, ratings, photos, and related personal information about the whiskies you try ("Your Content").
You retain ownership of Your Content. By submitting Your Content to Peated, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and transmit Your Content solely for the purpose of operating Peated and showing it to the friends you connect with inside the app.
You can delete Your Content at any time from within the app. When you delete an entry, it is removed from our live systems promptly; residual backups may persist for a short period before routine rotation clears them.
You agree not to use Peated to:
Peated includes an optional social feature that lets you send and accept friend requests and view the collections of friends who accept. You control who sees your content by choosing who you become friends with. You can also disable discovery in your settings to prevent other users from finding your account or sending you friend requests.
You can block any user at any time from inside the app. Blocking silently removes the friendship (if one exists) and prevents the blocked user from seeing your profile, sending you requests, or finding you via email lookup.
You can report any user, bottle, tasting note, or photo that you believe violates these Terms. Reports go directly to our moderation team.
Peated has zero tolerance for objectionable content and abusive behaviour.
We review reports within 24 hours and take appropriate action, which may include removing content, warning the user, suspending the account, or permanently banning the user. In urgent cases involving threats or illegal activity, we may act immediately and contact the relevant authorities.
We reserve the right, but not the obligation, to monitor, review, or remove any content at our discretion. We are not obligated to pre-screen content, and we are not responsible for content posted by users.
Peated offers an optional paid subscription ("Peated Premium") that unlocks additional features, including bottle scanning, the wishlist feature, shelf inventory tracking, and CSV data export.
Pricing: Peated Premium is offered at $1.99 USD per month or $14.99 USD per year. A 7-day free trial is available on the annual plan for eligible users. Local currency and exact price are shown by the App Store or Google Play at the point of purchase.
Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. Your Apple or Google account is charged for renewal within 24 hours before the period ends.
Cancellation: You can cancel at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current paid period; you keep Premium access until then.
Refunds: Refund requests are handled by the App Store or Google Play under their standard refund policies. We cannot process refunds directly.
Free trial: If you start a free trial on the annual plan and do not cancel before the trial ends, you will be charged for the annual subscription at the listed price.
The Peated app, including its name, logo, design, code, and any content we create, is owned by Glowing Galaxy and protected by copyright and trademark law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes under these Terms.
Distillery names, bottle names, and third-party trademarks referenced inside Peated remain the property of their respective owners. We do not claim any affiliation with or endorsement by any distillery or producer unless explicitly stated.
Peated is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the app will be uninterrupted, error-free, or free of viruses. We do not guarantee the accuracy of any age statements, ABV values, or information suggested by our automated bottle-label scanner. Always verify details against the physical bottle before making purchasing decisions.
We are not responsible for the content, conduct, or actions of other users, including content that appears on a friend's collection page. Friendships and interactions between users are your own.
To the maximum extent permitted by law, Glowing Galaxy and its affiliates, officers, and employees will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of Peated.
Our total liability to you for any claim arising out of or related to these Terms or your use of Peated will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) $50 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by law.
You can stop using Peated and delete your account at any time through the in-app Delete Account flow, or by visiting peated-1dd26.web.app/delete-account.
We may suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or use Peated in a way that risks harm to us or other users. In serious cases we may terminate immediately and without notice. When your account is terminated for a violation, your content is removed and you are prohibited from creating a new account.
We may update these Terms from time to time. When we make material changes, we will update the "Effective" date above and give you reasonable notice — for example, through an in-app message or by email. Your continued use of Peated after a change means you accept the updated Terms.
The following terms apply when you download or use Peated on an Apple device obtained through the Apple App Store. They supplement, and where required prevail over, the rest of these Terms for that use.
These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-laws provisions. Any dispute arising out of or related to these Terms will be resolved in the courts located in the State of Tennessee, USA, and you consent to that exclusive jurisdiction. Nothing in this section limits Apple's rights as a third-party beneficiary under Section 13.
